Book a demo callThese Terms of Service (the Terms) apply to the use of the Catchline Automation website and to the purchase or use of any services provided by us. Catchline Automation is operated by Lucas Ellis trading as Catchline Automation, a sole trader established in England. By accessing our website, purchasing a plan, subscribing to a recurring service, paying an invoice, completing a checkout, or otherwise using our services, you agree to be bound by these Terms.
Our services are intended for business customers, including local trades businesses, contractors, and service businesses. By using our services, you confirm that you are acting for business purposes and have authority to enter into these Terms on behalf of yourself or your business.
We provide automation, workflow, AI-enabled process, lead handling, communication, integration, implementation, optimisation, and related support services. This currently includes a done-for-you missed-call SMS recovery system for local trade businesses and related automation services. Our missed-call recovery services may include automated SMS replies, AI-assisted conversation handling, lead qualification, call forwarding, CRM or opportunity updates, review request messages, internal notifications, dashboard setup, and related workflow automations. These systems are designed to assist with lead handling and follow-up. They do not replace your own customer service, sales process, emergency response process, professional judgement, or responsibility to monitor and respond to customers. The exact scope depends on the plan, proposal, statement of work, or checkout page. Anything not expressly included is outside scope and may require an additional fee.
A binding contract is formed when you complete checkout, pay a fee or invoice, confirm acceptance in writing, request that we begin work, or continue to use the services after being shown these Terms. You are responsible for checking that the selected plan and pricing are suitable before ordering.
Fees may include one-off setup fees, recurring monthly fees, usage-based charges, or pass-through third-party costs. Recurring fees are payable in advance. You authorise recurring payments through Stripe. We may suspend services if payment is overdue. All fees are exclusive of VAT unless stated otherwise. Services are subject to fair and reasonable usage. Excessive usage may require a plan change or additional charges.
Subscriptions renew automatically unless cancelled. Cancellation takes effect at the end of the current paid billing period with no refund for time already started. If cancelled, we may suspend automations, workflows, hosting, and related services. The client retains ownership of their business name, domain, logo, branding, images, written content, and customer information. Catchline Automation retains ownership of reusable templates, design systems, code structures, automations, and technical setup methods. While active, the client receives a licence to use the website. After cancellation, website hosting, maintenance, and updates end. The client keeps their domain name. Transfer or export of the website may be subject to a separate fee. We may remove the hosted website after the subscription ends unless otherwise agreed.
You must provide all necessary information, approvals, logins, and access for us to provide services. You are responsible for the legality and accuracy of your content, customer data, and communications. You are responsible for promptly reviewing and responding to leads and notifications. We are not responsible for lost leads or revenue caused by delayed follow-up by you. You must provide accurate business information and ensure all automated communications comply with applicable laws including UK GDPR and PECR.
Our services may rely on third-party software including GoHighLevel, Stripe, Twilio, and Google. We are not responsible for outages, failures, or changes caused by third-party providers.
Services may involve call forwarding, SMS messaging, and phone number configuration through third-party providers. We do not guarantee calls or SMS will always be delivered correctly. We are not responsible for failures caused by third-party telephony providers.
We do not guarantee uninterrupted operation. Services may be unavailable from time to time due to maintenance, third-party outages, or events outside our control.
Our services are not an emergency dispatch or emergency response service. You remain responsible for monitoring your own communications and responding to urgent enquiries.
We provide services using reasonable care and skill but do not guarantee any specific business result, including leads, sales, bookings, reviews, revenue, or return on investment. We do not guarantee that customers will leave Google reviews or that your ranking will improve.
We retain ownership of pre-existing materials, templates, methods, and workflows. Subject to full payment, you receive a non-exclusive right to use deliverables created for you. You retain ownership of your own branding and customer data.
Each party must keep the other party's confidential information confidential except where reasonably necessary to perform the services or required by law.
Each party must comply with UK data protection law. Where we process personal data on your behalf, you act as controller and we act as processor. You are responsible for having a lawful basis for your customer data. See our Privacy Policy for further details.
We may suspend or terminate services if you fail to pay, breach these Terms, provide harmful content, or create compliance risk. On termination we may disable automations, remove access, and close active service delivery.
Nothing excludes liability for death, personal injury, fraud, or fraudulent misrepresentation. Subject to that, we are not liable for indirect or consequential loss. Our total liability shall not exceed fees paid in the 6 months preceding the claim.
We may update these Terms. The latest version will be posted on our website. Continued use means you agree to the revised Terms.
These Terms are governed by the law of England and Wales. If any provision is invalid, the rest remains in force.
